Terms of service
General Terms and Conditions (GTC) for the online shop www.e-leiwand.at
Last updated: 29 September 2026
1. Scope and contracting party
(1) These General Terms and Conditions (GTC) apply to all orders of goods placed by consumers within the meaning of § 1 of the Austrian Consumer Protection Act (KSchG) via the online shop www.e-leiwand.at (“online shop”) or directly with Ampion GmbH by telephone or email.
The contracting party is: Ampion GmbH, Hackinger Straße 52, A-1140 Vienna, FN 643205s (Commercial Court of Vienna), VAT ID ATU81638024, email: onlinesales@ampion.at, telephone: +43 676 3575601, service hours: Mon–Thu 9:00 a.m.–5:00 p.m., Fri 9:00 a.m.–1:00 p.m. (hereinafter “Ampion” or “we”).
(2) If an order is placed by a legal entity, an entrepreneur within the meaning of § 1 of the Austrian Business Code (UGB) or a natural person evidently for the purposes of their commercial or self-employed professional activity, these GTC do not apply; in this case, the separately available “General Terms and Conditions for Business Customers (B2B)” of Ampion GmbH apply. Business customers are asked to contact sales@ampion.at or to use the B2B web shop of Ampion GmbH at www.ampion.at.
(3) Deviating, conflicting or supplementary terms and conditions of the customer shall not become part of the contract unless Ampion expressly agrees to their validity in writing.
2. Conclusion of the contract
(1) The presentation of products in the online shop does not constitute a binding offer by Ampion, but an invitation to the customer to submit an offer.
(2) By completing the ordering process (clicking on “Order with obligation to pay” or an equivalent button), the customer submits a binding offer to conclude a purchase contract.
(3) Ampion confirms receipt of the order without delay by email (“order confirmation”); this does not yet constitute acceptance of the offer. The contract is only concluded when Ampion expressly accepts the order or dispatches the goods (shipping confirmation), but at the latest upon delivery of the goods.
(4) Before submitting the order, the customer can identify and correct input errors using the correction and deletion functions provided in the ordering process.
3. Prices and terms of payment
(1) All prices stated are in euros and include the applicable statutory VAT. Shipping costs are calculated in accordance with our Shipping Policy and are shown separately before the order is completed.
(2) If Ampion advertises a price reduction by comparison with an earlier price, the lowest total price that Ampion charged in the online shop within the last 30 days before the reduction was applied is stated in accordance with § 9a of the Austrian Price Labelling Act (PrAG).
(3) The following payment methods are offered: credit card (Visa, Mastercard, Maestro, American Express, UnionPay), PayPal, Klarna, eps bank transfer, Bancontact, Apple Pay, Google Pay, Shop Pay and prepayment by bank transfer. Which payment methods are available in an individual case depends on the country of delivery and the device used; the selection offered in the ordering process is decisive. No additional fees are charged for the use of any payment method.
(4) The purchase price is due upon conclusion of the contract. For payment by credit card, PayPal, eps bank transfer, Bancontact, Apple Pay, Google Pay or Shop Pay, the amount is charged when the order is completed. For payment with Klarna, Klarna’s terms and conditions apply in addition. For prepayment, the purchase price must be transferred within 3 calendar days of the order confirmation to the account stated therein; the goods are shipped once payment has been received. If payment is not received on time, we are entitled to withdraw from the contract.
4. Delivery
(1) Delivery is made to the delivery address specified by the customer in one of the delivery countries selectable in the ordering process. Deliveries to other countries are possible on request.
(2) The following standard delivery times apply to items in stock: Austria 1–3 working days, Germany 3–5 working days, other delivery countries 3–7 working days. The delivery time begins upon conclusion of the contract or, in the case of prepayment, upon receipt of payment. If the delivery time of a product differs from this, it is stated on the respective product page. If, exceptionally, no delivery time is stated, we deliver within 30 calendar days of conclusion of the contract at the latest (§ 7a KSchG).
(3) We ship parcels with Österreichische Post, GLS, DPD or an equivalent parcel service. Bulky or heavy goods (e.g. charging pillars, DC charging stations) are delivered by freight forwarder to the kerbside; moving the goods to their final installation location is not part of the delivery unless separately agreed as a service.
(4) We are entitled to make partial deliveries insofar as these are reasonable for the customer. We bear any additional shipping costs incurred as a result.
(5) The risk of accidental loss or accidental deterioration of the goods only passes to the customer upon handover to the customer or to a third party designated by the customer other than the carrier (§ 7b KSchG).
(6) If an ordered product is not available through no fault of our own despite timely ordering from our supplier in line with demand, we are entitled to withdraw from the contract. In this case, we will inform the customer without delay and refund any payments already made without delay (reservation of self-delivery).
5. Right of withdrawal and voluntary right of return
(1) In the case of distance contracts, consumers have a right of withdrawal pursuant to §§ 11 et seq. of the Austrian Distance and Off-Premises Contracts Act (FAGG).
Information on the right of withdrawal
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. If you have ordered multiple goods in one order that are delivered separately, the period begins on receipt of the last good.
To exercise the right of withdrawal, you must inform us (Ampion GmbH, Hackinger Straße 52, A-1140 Vienna, email: onlinesales@ampion.at, telephone: +43 676 3575601) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use our online withdrawal form or the model withdrawal form (PDF) for this purpose; both are also available at https://e-leiwand.at/policies/refund-policy. Their use is not obligatory, but it helps us to process your withdrawal quickly.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exclusion and expiry of the right of withdrawal
(2) Pursuant to § 18 FAGG, the right of withdrawal does not exist or expires prematurely in the case of:
- goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive, or which are clearly tailored to the consumer’s personal needs (e.g. individually configured charging stations with customer-specific cable length, equipment or wrapping);
- contracts for services (e.g. installation service) that have been fully performed, if Ampion only began performance after the customer’s express consent and the customer’s prior acknowledgement that they will lose their right of withdrawal once the contract has been fully performed.
Voluntary right of return
(3) In addition to the statutory right of withdrawal, we grant consumers a voluntary right of return for a total of 30 days from receipt of the goods. The prerequisite is that the goods are returned unused, not installed or not put into operation, undamaged and complete (including accessories and instructions, where possible in the original packaging). Excluded from the voluntary right of return are special-order items, i.e. articles that Ampion does not keep in stock and procures specifically for the customer’s order; the statutory right of withdrawal pursuant to para. 1 applies to these. The customer bears the cost of the return shipment. The voluntary right of return does not limit the statutory right of withdrawal or the statutory warranty rights. Details are set out in our Return Policy.
6. Retention of title
The goods delivered remain the property of Ampion until the purchase price has been paid in full.
7. Warranty
(1) The statutory warranty pursuant to the Austrian Consumer Warranty Act (VGG) and the Austrian Civil Code (ABGB) applies. The warranty period for movable goods is two years from handover. If a defect becomes apparent within one year of handover, it is presumed to have existed at the time of handover, provided this is compatible with the nature of the goods or the defect.
(2) For goods with digital elements (e.g. charging stations with app connectivity or firmware), Ampion ensures in accordance with § 7 VGG that the customer is provided with necessary updates (in particular security updates) for the period of time the customer can reasonably expect, but for at least two years from handover – even if these are provided by a third party (e.g. the manufacturer).
(3) Manufacturer’s guarantees going beyond the statutory warranty apply only insofar as they are separately and expressly granted by the respective manufacturer; their scope, duration and conditions are set out in the manufacturer’s respective guarantee statement. Statutory warranty rights are not limited by a guarantee.
8. Liability
(1) Ampion is liable without limitation for damage resulting from injury to life, body or health, as well as for intent and gross negligence.
(2) Otherwise, in particular for property damage caused by slight negligence, Ampion’s liability is excluded; this also applies to the liability of vicarious agents. This exclusion does not apply to damage to items that Ampion has taken over for processing.
(3) Liability under the Austrian Product Liability Act (PHG) remains unaffected.
(4) Ampion is only liable for loss of data or interruptions to online services connected with the product in the event of intent or gross negligence.
9. Product safety
As an economic operator within the meaning of Regulation (EU) 2023/988 (General Product Safety Regulation, GPSR), Ampion complies with the information and cooperation obligations provided for therein. Information on the manufacturer or the responsible person in the EU as well as warnings and safety information can be found on the respective product page or in the documentation enclosed with the product. Please send reports concerning product safety to onlinesales@ampion.at.
10. Applicable law, place of jurisdiction
(1) Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected.
(2) For actions brought by consumers against Ampion and by Ampion against consumers, the court at the consumer’s place of residence has jurisdiction – insofar as this can lawfully be agreed.
11. Dispute resolution
(1) We are not legally obliged to participate in dispute resolution proceedings before a recognised consumer arbitration body pursuant to the Austrian Alternative Dispute Resolution Act (AStG) and do not currently participate in such proceedings as a general rule.
(2) If a dispute arising from this contract cannot be settled amicably, Ampion will inform the consumer in accordance with § 19 (3) AStG on a durable medium (e.g. by email) of the competent alternative dispute resolution body and whether Ampion will participate in the relevant proceedings.
12. Final provisions
(1) Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
(2) Concluded contracts are governed by the GTC valid at the time the contract was concluded.
