General Terms and Conditions

1. Scope

These General Terms and Conditions apply to all contracts for the sale of products and services in the field of renewable energy, in particular charging stations, PV components, battery storage systems and related accessories, as well as associated services, concluded with Ampion GmbH via its websites or other sales channels. Deviating provisions apply only if they have been expressly agreed in writing.

2. Conclusion of contract

The products and prices shown are non-binding. A contract is concluded only when Ampion accepts the order. Confirmation that the order has been received does not constitute acceptance. The contract becomes effective upon receipt of a separate declaration of acceptance, such as a shipping confirmation.

3. Prices & payment terms

All prices are stated in euros including statutory VAT. Shipping and packaging costs are shown separately. For orders within Austria, the prices valid at the time of ordering apply.

Payment can be made by credit card, PayPal or bank transfer. No additional charges are imposed by us for payments from within the EU.

4. Right of withdrawal for consumers

Consumers within the meaning of the Austrian Consumer Protection Act (KSchG) have a statutory 14-day right of withdrawal for distance contracts. The period begins on the day on which the customer, or a third party designated by the customer, takes possession of the goods.

If several products from one order are delivered separately, the period begins upon receipt of the final item.

Ampion provides further information, including the procedure and form, in its withdrawal information. The customer bears the return-shipping costs unless otherwise agreed. Freight items, such as large battery-storage systems, may incur separate transport costs; these will be communicated in advance.

5. Exclusion of the right of withdrawal

There is no right of withdrawal in cases provided for by law, including:

  • products individually configured or made to customer specifications,
  • services that have already been fully performed where performance began at the customer's express request before the end of the withdrawal period and the customer was informed about the loss of the right of withdrawal,
  • products that are not suitable for return for reasons of electrical safety or hygiene once a seal has been removed, where the statutory requirements for such an exclusion are met (e.g. energy modules with safety-relevant components).

6. Delivery

Goods are delivered from stock to the delivery address specified by the customer. Larger equipment may be delivered by freight carrier to kerbside.

The delivery period is generally up to 5 working days and in any event within 30 days of conclusion of the contract unless a longer delivery period has been agreed.

7. Services / installation service

Ampion offers optional services in the field of renewable energy, for example connecting PV inverters, setting up energy-management systems or commissioning charging stations.

Services are provided exclusively on the basis of:

  • existing connections that comply with applicable standards (electricity, internet and, where relevant, water),
  • the supplied or agreed installation materials,
  • installation locations that are reachable and accessible without additional construction work.

The following are not included:

  • changes to the building's electrical installation,
  • laying cables,
  • modifications to wall or floor structures,
  • work on inaccessible, non-compliant or damaged connections, for example inadequately dimensioned protective components or heat-damaged cables.

8. Retention of title

The goods remain the property of Ampion until payment has been made in full. Transfer or pledging of the goods before title has passed is not permitted.

9. Statutory warranty & manufacturer's guarantee

For consumers, the statutory warranty periods apply (24 months).

Any manufacturer's guarantee extending beyond the statutory warranty can be claimed only where such a guarantee has been granted separately. Decisions on claims under a manufacturer's guarantee are made exclusively by the manufacturer. If a chargeable cost estimate is prepared, for example after rejection of a guarantee claim, the costs will be communicated in advance.

10. Liability

Ampion is liable for damage caused by gross negligence or intent. Ampion is liable for personal injury in accordance with the applicable statutory provisions. For data loss or business interruptions involving electrical components, Ampion is liable only within the limits permitted by law and where the damage is attributable to Ampion and the customer has taken reasonable backup or protective measures.

11. Jurisdiction & choice of law

Austrian law applies to all disputes arising from or in connection with this contract, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If the customer is a consumer whose habitual residence is in Austria, the court with subject-matter jurisdiction at the customer's place of residence has jurisdiction in accordance with Section 14 KSchG.

12. Online dispute resolution / ombudsman service

Ampion participates in the dispute-resolution procedure of the Austrian Internet Ombudsman. Complaints may also be submitted via the EU online dispute-resolution platform where that platform is available and applicable:
